Buying Property in Nicaragua
Property ownership in Nicaragua is fee simple with title issued in your name. For those with Nicaraguan or Latin American real estate experience and the ability to speak fluent Spanish, buying directly from a local property owner is a fairly simple process. The reality is that most of us are not Nicaraguan real estate experts and likely speak little Spanish if any at all. Purchasing real estate in Nicaragua is essentially a process involving three key players. These players include the buyer, the seller, and the notary. In Nicaragua, the position of notary is the highest level of attorney qualification, which is certified and awarded by only the Nicaraguan government.
Once you have selected your Nicaraguan property and have agreed upon a price, the notary will prepare a promesa de venta (promise to sell). This is a three-party agreement, signed by the buyer, seller, and notary. Upon its execution, the notary will prepare a testimonio. The testimonio is an exact copy of the promesa and is placed in the Nicaraguan public records to advise other prospective real estate buyers that the property is under contract.
Once all requirements of the promesa have been met, the notary will prepare an escritura (deed) to be signed by the buyer, seller, and notary. At this point, a testimonio is prepared. The testimonio is taken to the Nicaraguan property registry and a property appraisal is completed. An appraisal certificate is issued and submitted to the IRS, along with the testimonio. Once the transfer taxes have been paid the testimonio is recorded in the Nicaraguan public registry office at the local municipal. Once the testimonio is recorded, the sale process is complete.
